TERMS AND CONDITIONS OF SALE

These terms govern bookings of the stays offered by Cabalarte through the website cabalarte.com. They apply exclusively to private individuals acting as consumers. Making a booking implies full acceptance of these terms.
Stays are provided by Marion Groult (Cabalarte), whose details appear in the Legal Notice.
Bookings are made online through the SuperHote booking engine, accessible from the website. The customer selects the dates and number of participants, reviews the booking summary, confirms it and pays. The booking is final upon receipt of the confirmation email. The customer undertakes to provide accurate information.
Prices are shown in euros, all taxes included. The applicable price is the one displayed at the time of booking.
Payment is made by bank card through Stripe, a secure payment provider. Cabalarte never has access to the customer's full card details. The amount is charged [at the time of booking – TO BE CONFIRMED].
6. No right of withdrawal
Under Article 103(l) of the Spanish consolidated General Law for the Protection of Consumers and Users (Royal Legislative Decree 1/2007), the 14-day right of withdrawal does not apply to accommodation and leisure services provided on a specific date or for a specific period. Only the cancellation policy below applies.
7. Cancellation by the customer
Cancellations must be notified by email to cabalarte.es@gmail.com or through SuperHote.
– Cancellation at least 7 days before the arrival date: full refund (100%).
– Cancellation less than 7 days before the arrival date, or no-show: no refund. [TO BE CONFIRMED]
– Early departure or interruption of the stay: no refund.
Refunds are made to the original payment method within 14 days.
8. Cancellation or modification by Cabalarte
If Cabalarte has to cancel or modify a stay due to force majeure or for safety reasons, the customer will be offered alternative dates or a full refund of the amounts paid.
9. Participation requirements
– Minors must be accompanied by, and remain under the responsibility of, their parents or legal guardians.
– No particular fitness level or clothing is required.
– Participants agree to follow the safety instructions given by Cabalarte and the rules of the premises.
The customer is liable for any damage caused by them, or by minors in their care, to persons, property and facilities.
Cabalarte is not liable for damage resulting from failure to follow safety instructions, from the fault of the participant or a third party, or from force majeure, nor for the loss or theft of personal belongings.
In accordance with Article 86 of Royal Legislative Decree 1/2007, nothing in these terms limits or excludes Cabalarte's liability for death or personal injury attributable to it, or for wilful misconduct or gross negligence.
Complaints may be sent to cabalarte.es@gmail.com. Official complaint forms (hojas de quejas y reclamaciones of the Junta de Andalucía) are available to customers on site.
12. Governing law and jurisdiction
These terms are governed by Spanish law, without depriving consumers of the protection afforded by the mandatory provisions of the law of their country of habitual residence. Any dispute shall fall within the jurisdiction of the courts of the consumer's place of residence.
